Welcome to Garjoo online marketplace. This website and its mobile applications are owned and operated by Garjoo Inc, Edmonton Alberta .By using this website the user, you agree to the following Garjoo User Agreement . Please discontinue your use of the website and its mobile applications if you do not agree to Garjoo User Agreement.

Definitions : For the purposes of this Garjoo User Agreement Following bold words have meanings defined under the following conditions.

You : The individual using or accessing Garjoo.com and its mobile applications , the company or other legal entity on behalf of which individual is using or accessing Garjoo , as applicable

Garjoo: Referred to as either ‘garjoo’,  garjoo.com, ‘garjoo.com,np’, ‘garjoonepal.com’, ‘garjoo.ca’, , Garjoo’s, and ‘mobile applications'’, ‘our’ ,’us’ in this agreement refers to Garjoo Inc, Edmonton Alberta and its service providers- Windsor, Ontario and  Bagmati, Kathmandu. 

Affiliate: Is an entity that Garjoo controls with the ownership of 51% or more of the shares entitled to vote for election.

User account: Is the account created for you to access the website and its mobile applications.

Website: Refers to “Garjoo”, and” It’s mobile applications”, can be accessed from  www.garjoo.com, www.garjoonepal.com, garjoo.ca  and mobile applications.

Service: Means its website and mobile application service.

Service provider: Any legal individual who works on behalf of Garjoo Inc , Garjoo Private Limited Or employed by Garjoo or it’s affiliates or subsidiaries to work on it’s website and it’s mobile application services.

Third party: Refers to any social network website or any website through which user can log in or create an user account.

Personal information : Means any information of an identified or identifiable individual. For example , your name, address, e-mail address or telephone number.

Cookies: Means a small text file that are placed on your computer or mobile device which contains the details of your browsing on that website. The main purpose of a cookie is to identify users and possibly customize web pages for them. For more information please click cookies.

Usage data: Means the data collected either by the use of the service or form website or it’s mobile applications infrastructure.

1. To enhance the performance of the contract with Garjoo.
2. To provide you with general information about other items or services Garjoo offers which are similar to the ones you have already purchased or have been looking for or have previously enquired about only if you have indicated that you wish to receive additional information, promotional material with details of any offers Garjoo may have available from time to time.
3. Garjoo may share your personal information during negotiations of any merger, sale of Garjoo’s assets, or acquisition of a business to another company.
4. We may share your information with Garjoo’s affiliates only if those affiliates honor this privacy policy and terms of use.
5. When you interact in the public areas with other users, your information may be viewed by other users and may publicly be distributed outside.

BY USING THIS WEBSITE THE USER, YOU AGREE TO THE FOLLOWING GARJOO USER AGREEMENT: TERMS AND CONDITIONS OF USE.PLEASE DISCONTINUE YOUR USE OF THE WEBSITE AND ITS MOBILE APPLICATIONS IF YOU DO NOT AGREE TO GAROO USER AGREEMENT.

Garjoo updates or may change its terms and conditions without notice. Regular review of Terms and Conditions keeps you updated. Your continued use of the website and its mobile applications signifies your acceptance of these terms and any changes in effect at the time of use.

General

1. You will not post any items which are prohibited by a local, national or international law, including but not limited to any regulations having the force of law or Garjoo’s restricted items policy in any country.
2. Only registered users can post their items on the website.
3. At the registration stage, you agree to provide accurate information about yourself such as your name, your phone number, your residential address, and your email address.
4. You will receive an activation link or code in your email or phone confirming your registration.
5. You will read all the terms and policies and indicate your consent to be bound by this website’s and its mobile user agreement policy, terms of use, and restricted items policy. You must finish all the registration process to get website access.
   • 5A. You will post items in its category.
   • 5B. You will not post copyrighted materials and unauthorized intellectual property.
   • 5C. You will not email, distribute, or upload any content that contains computer viruses.
   • 5D. You will not post any items or information that infringes third- party rights.
   • 5E. You will not collect any information on website users including their identification details.
   • 5F. You will not use automated devices to access websites for any reason.
   • 5G. You will not make Garjoo.com.np and its mobile applications liable for your inability to use the service wholly or partially due to any reasons.
6. You will not bring or institute any action, claim, or legal proceeding against Garjoo Inc and its subsidiaries or affiliates in any country for the loss or damage of any kind arising from the use of Garjoo website and its mobile applications. Any damage or risk caused due to the posting of material by member or visitor which may include dishonest, defamatory, or offensive material rests entirely with each registered user or website visitor. Garjoo.com will have no liability to anyone.
7. You agree to indemnify Garjoo.com including its subsidiaries, affiliates, it’s, and their employees, agents, directors, and officers harmless from any losses, claims, or liabilities, including any legal cost arising from your breach of this agreement or terms of use.
8. Fees: Most of the Garjoo website features and services and its mobile application is free to use but we have paid only services too. You will be notified and will be asked to review and accept the fee. We charge periodical fees in Nepalese currency. Fees may change from time to time but will inform you when it changes. Fees are non- refundable; a careful review is necessary before you decide to pay or you can call our customer service or use online webchat service.
9. Mobile applications: We provide services through Google’s Android and Apples app. Both Google and Apple are not responsible for the content and application. Both of these applications have no obligations for the maintenance and support services with respect to this applications.

3. Restricted items policy :

Restricted items policy

Posting of following items in the Garjoo website and in its mobile applications are prohibited.

Weapons:

Biological, chemical or nuclear weapons,

Weapons of mass destruction, arms munitions, military weapons and any related parts or components of such weapons.

Any replica weapons, BB and pellet guns Tear gas, stun guns, crossbows and material arts weapons are strictly prohibited.

Explosives:

Ignition and detonation, a radioactive substance, fireworks and firecrackers, and associated items or products.

Stocks and Securities :

Any products of security or finance-related.

Pornography

Any material or information that includes nude photos, videos, erotic products, prostitution, and escort.

Exception: Sex toys are permitted to be listed without nudity. (Only in B2B).

Territorial or Racially sensible and offensive items

Any posting that contains information on discrimination on the basis of race, sex, and or religion is strictly prohibited.

Illegal drugs and drug paraphernalia

Any mention of related items including narcotics, tranquilizers, psychotropic, and steroids.

Prescribed drugs.

Only over the counter drugs may be permitted.

Medical instruments

Members can post authorized medical devices. Documentation required from the related authority of posters country.

Chemicals

Toxic and Poisonous Chemical.

Proper government documentation is required.

Illegal services

Any government issues identification documents or equipment to design those documents, money transfer services.

Medical and health care services.

Non-business items or information.

Precious Metals :

listing of or buying of diamonds, gold, silver, and other precious metals.

Exception: Jewellery

Intellectual or Copyrighted materials

Animal and human body parts

Exception: Wigs for commercial use is permitted

Poultry, livestock, and pets for a commercial purpose are permitted.

Knives, swords, Khukuri

Listing of kitchen knives are permitted

Gambling materials or information

Stolen property

Government Sanctioned items

Digital items or accounts

Baby items deemed unsafe by the health authority of posters country

Alcohol

Empty bottles, labels, and cap as collectible are permitted.

Restricted food products

4. Review and testimonials writing Policy: :

Garjoo website user agrees to the following terms and conditions to write the review and testimonials.

1. You agree to provide your true and verifiable identification information. ( your information is safe with us, and will be handled according to Garjoo privacy policy. (please review Garjoo privacy policy).
2. You agree that you are writing your direct experience with the product and not any other person’s opinion including your relatives, friends, and family
3. You agree that you will not use socially inappropriate words to write your experience relating to the product or service.

Each Garjoo website users, reviewers, and testimonial providers agree that they release and indemnify Garjoo.com its mobile applications and Garjoo’s affiliates directors, managers, officers, employees and agents from all actions, damages, and claims in the event that review writers or testimonial providers have a dispute with any party to review writing or testimonial providing.
